Terms of Service

Effective September 26, 2026

1. Purpose

These terms set out the conditions and procedures for using Atmark (“the service”) and the rights and obligations of the service and its users.

The service is operated by SHAKA, a sole proprietorship represented by Younkyum Jin, in the Republic of Korea.

2. Definitions

  1. “Owner” means the person who signs up, creates an organization and manages that organization’s agents.
  2. “Organization” means the unit an owner creates at sign-up; agents and sending policies belong to it.
  3. “Agent” means software an owner registers with the service so that it can send and receive mail from an @atmark.ai address.
  4. “Token” means the secret value an agent uses to connect to the service.
  5. “Gate” means the policy-decision step that every message an agent sends passes through.

3. Effect and changes

These terms take effect when posted on the service. We may change them to the extent permitted by law; when we do, we will post the new terms, their effective date and the reason before they take effect, and give ample notice of changes that are unfavorable to you. If you do not agree to the changes, you may stop using the service and close your account.

4. Sign-up and operator review

  1. You sign up by entering an email address and an organization name, then opening the confirmation link sent to that address.
  2. Every new organization is reviewed by an operator. You can create agents and tokens while the review is under way, but sending to outside recipients opens only after the review is complete.
  3. We may decline a sign-up, or keep outside sending closed, where we suspect abuse or where sign-up details are not accurate.

5. Beta service

The service is in beta. Features, sending limits and screens may change without notice, and the service may be interrupted or delayed. We work to keep it running reliably but do not promise any particular level of availability.

6. Plans and payment

  1. Paid plans (Pro, Team and Scale) renew automatically every month. Paddle.com processes payments, tax and billing as our Merchant of Record, and Paddle’s buyer terms also apply to your payment.
  2. You can cancel a paid plan at any time from billing in the console. After you cancel, your plan stays active until the end of the period you have already paid for. Refunds follow our Refund Policy.
  3. If we change prices, we will tell you before your next renewal. Plans and prices are listed on our Pricing page.
  4. The Beta plan is free for organizations that pass review. We will tell you before the beta ends.

7. Owner responsibilities

  1. You are responsible for the mail your organization’s agents send and for its consequences.
  2. You must keep tokens secure, and revoke the token or suspend the agent right away if you suspect a leak.
  3. You must handle the personal information of the people your agents correspond with in accordance with applicable law.

8. Prohibited use

You must not use the service, or have your agents use it, to:

  • send mail that violates the Act on Promotion of Information and Communications Network Utilization and Information Protection of Korea or similar laws, such as commercial advertising sent without the recipient’s consent
  • send phishing, distribute malware, or impersonate another person or organization
  • bypass or disable the gate or the sending policy
  • interfere with other users or with the normal operation of the service
  • do anything else that violates applicable law

9. Restrictions

If you breach these terms or the law, or if your sending risks harming recipients or other users, we may suspend or freeze sending for an agent or for your organization. We will notify you in advance where possible, and afterwards when action has to be taken urgently.

10. Changes to and suspension of the service

We may change or suspend all or part of the service for operational or technical reasons. If we shut the service down, we will give reasonable advance notice.

11. Limitation of liability

We are not liable for losses caused by events beyond our control, such as natural disasters, causes attributable to you, or outside mail servers rejecting messages or classifying them as spam, except where the loss results from our intent or gross negligence.

12. Closing your account

You may ask to close your account at any time. When we receive the request, we stop sending for your organization’s agents and handle your personal information as described in the Privacy Notice.

13. Governing law and jurisdiction

These terms are governed by the laws of the Republic of Korea. Disputes between the service and its users are handled by the court with jurisdiction under the Civil Procedure Act of Korea.

This English version is provided for convenience. If it differs from the Korean version, the Korean version prevails.
